The U.S. Office of Federal Contract Compliance Programs (OFCCP) has posted a request for comments regarding a proposed rule to rescind Executive Order (EO) 11246. EO 11246 was revoked by President Donald Trump’s EO 14173  on Jan. 31. The EO 11246 prohibited covered federal contractors and subcontractors from discriminating in employment based on race, color, religion, sex, sexual orientation, gender identity and national origin and required them to take affirmative action on those bases.

The OFCCP is proposing to remove the following parts:

41 CFR part 60-1: Obligations of Contractors and Subcontractors
41 CFR part 60-2: Affirmative Action Plans
41 CFR part 60-3 : Uniform Guidelines on Employee Selection
41 CFR part 60-4: Construction Contractors – Affirmative Action Requirements
41 CFR part 60-20: Discrimination Based on Sex

The OFCCP is proposing to revise 41 CFR part 60-30: Rules of Practice for Administrative Proceedings to Enforce Under EO 11246. The proposed revision includes a revised part title striking “to Enforce Under E.O. 11246”.
